Legal framework ALAS processes your personal data in accordance with the Constitution of the Bolivarian Republic of Venezuela, in particular Article 28 (habeas data — access, rectification, and deletion of personal data) and Article 60 (right to privacy), as well as the principles established by Decision No. 1318 of the Constitutional Chamber of the Supreme Tribunal of Justice (TSJ) of August 2011, including the principles of free will, legality, purpose and quality, accuracy and self-determination, and foreseeability and integrity. Subscription does not require an account and can be cancelled at any time. 4.2 Information collected automatically • Technical data: IP address, browser type and version, operating system, device information, and language preferences. • Usage data: pages visited, time spent, courses viewed, access timestamps, and referring URLs. • Session data: login and logout times, session duration, and authentication tokens. 4.3 Information from third parties • Payment processors: transaction confirmation data (Zelle, Pago Móvil, bank transfer, Binance). How we use your information We process your personal data for the following purposes: • a) Providing access to the platform, courses, and learning materials. • b) Managing your account, enrollment, and progress. • c) Processing payments for ALAS proprietary courses and verifying proof of payment. • d) Tracking academic progress, issuing grades, and generating completion certificates. • e) Verifying certificate authenticity through our online verification system. • f) Sending notifications related to your courses, account, and platform updates. • g) Responding to inquiries and providing technical support. • h) Sharing academic records with the relevant ATO for certification purposes, where applicable. • i) Complying with regulatory requirements from aviation authorities (INAC or equivalent), where applicable. • j) Improving platform security, performance, and functionality through analytics. • k) Informing you about new courses, updates, or services that may interest you (you may opt out of marketing communications at any time). 6. Legal basis for processing We process your personal data on the following legal grounds: • a) Consent: by creating an account and accepting these policies, you provide free, prior, informed, and revocable consent for the processing described herein. • b) Contractual necessity: processing necessary to provide the services you request, including course access, enrollment management, and certificate issuance. • c) Legal obligation: processing necessary to comply with applicable laws, regulations, or aviation authority requirements. • d) Legitimate interest: processing necessary for our legitimate business interests, such as improving services, ensuring security, and preventing fraud, provided such interests do not override your fundamental rights. 7. Certificate verification and public data When a certificate is verified through our public verification system (by scanning the QR code or entering the certificate ID), only the following limited information is displayed to the person performing the verification: • a) The certificate holder's full name. • b) The name of the completed course. • c) The date of issuance. • d) The certificate status (valid / revoked). This information is limited to what is necessary to confirm the certificate's authenticity. The verification page does not allow downloading the certificate PDF, viewing grades, or accessing any other personal data. 8. Information sharing We do not sell, rent, or trade your personal data. We share your information only with the following parties and only for the purposes described: • Approved Training Organizations (ATOs): we share enrollment, completion, and certification data with the ATO delivering or certifying the course, limited to what is necessary for course administration and certification. These organizations are bound by confidentiality obligations. • Payment processors: transaction data is shared with banking institutions (for Pago Móvil and transfers), Zelle, and Binance, depending on the method used. These providers operate under their own privacy policies and are not controlled by ALAS. • Aviation authorities: when required by law or regulation, we may share academic records with the National Institute of Civil Aviation (INAC) or other applicable aviation authorities for audit, compliance, or oversight purposes. • Technology service providers: we use third-party providers to operate the platform, including OVHCloud (server hosting), Cloudflare (DNS, CDN, and security), Zoho (email services), and Sender (newsletter and bulletin delivery). These providers process data on our behalf under contractual confidentiality obligations, solely to facilitate the operation of our services. • Legal requirements: we may disclose your personal data when required by law, court order, or governmental regulation, or when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others. 9. International data transfers Our platform is hosted on OVHCloud servers physically located in the state of Virginia, United States of America. Additionally, some of our service providers (Cloudflare, Zoho, Sender) may process data in various international locations. By using the platform, you acknowledge and consent to the transfer of your personal data to the United States and other countries that may have data protection standards different from those of Venezuela. We take reasonable steps to ensure your data is treated securely and in accordance with this Policy, including using providers that maintain appropriate technical and organizational security measures. 10. Data security We implement appropriate technical and organizational measures to protect your personal data, including: • a) SSL/TLS encryption for all data transmitted between your browser and our servers. • b) Secure server infrastructure protected by firewalls, intrusion detection systems, and regular security updates. • c) CDN and DDoS protection through Cloudflare. • d) Restricted access to personal data on a need-to-know basis with role-based access controls. • e) Automated and manual backups of platform data. • f) Password hashing and secure authentication mechanisms. When personal data is no longer needed, it is securely deleted or anonymized. 12. Cookies and tracking ALAS LMS uses essential cookies required for platform functionality, including session management, authentication, language preferences, and interface settings. These cookies are necessary for the platform to operate and cannot be disabled. We use web analytics tools (such as Google Analytics) to understand usage patterns and improve our services. Acceptance of terms By creating an account, enrolling in a course, making a payment, or using any feature of ALAS LMS (skyalas.com), you agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and any additional referenced policies. If you do not agree with any part of these Terms, you must not use the platform. These Terms constitute a legally binding agreement between you and undefined ("ALAS", "we", "our", or "us"). 2. Definitions • Approved Training Organization (ATO): any legal entity authorized, certified, or approved by the National Institute of Civil Aviation of Venezuela (INAC) to provide aviation instruction or training, including without limitation Aviation Instruction Centers (RAV 141), Aviation Training Centers (RAV 142), and air operators with approved training programs (RAV 121, RAV 135, and equivalents). • Certified courses: courses delivered by an ATO under a training program approved by INAC. • Proprietary courses (non-certified): courses, workshops, virtual classes, or other training activities developed and offered directly by ALAS to enhance the competencies of aviation personnel, without regulatory certification. • Platform: the ALAS LMS learning management system, accessible at skyalas.com. • User: any person who accesses or uses the platform. • Student: a user enrolled in one or more courses. • Legal guardian: the parent or guardian who accepts these Terms on behalf of a user under 18 years of age. • Completion certificate: a document evidencing the completion of a training program; it does not constitute an aviation license or rating. 3. Platform description ALAS LMS is a learning management platform providing a digital environment for aviation training. Courses may be delivered online, in person, or in a blended format. ALAS operates in collaboration with Approved Training Organizations (ATOs). Certified courses are offered by these ATOs, while proprietary courses are offered directly by ALAS. ALAS provides the technology for course delivery, progress tracking, and certificate generation. The ATO is responsible for the academic content, instructor oversight, evaluation criteria, and regulatory certification of its courses. 4. Nature of the service and relationship model ALAS acts as a technology provider (platform). It is essential that you understand the distinction between the two course types, as it determines payment and liability obligations: 4.1 Certified courses (delivered by an ATO) For certified courses, the academic and commercial relationship is between the Student and the ATO. The ATO sets the price, collects payment from the Student, defines admission requirements, and issues certification. ALAS is not a party to the payment relationship between the Student and the ATO: it does not set the course price to the Student, does not collect payment from the Student, and does not manage refunds for those courses. ALAS receives its consideration from the ATO, under the B2B commercial agreement between ALAS and the ATO. 4.2 Proprietary courses (offered by ALAS) For proprietary (non-certified) courses, the relationship is directly between the Student and ALAS. ALAS sets the price, collects payment, and handles refund requests under these Terms. 5. Eligibility and minors To use the platform, you must: • a) Be at least 16 years of age. • b) Be capable of forming a legally binding contract under Venezuelan law or the law of your jurisdiction. In Venezuela, civil majority is 18 years. • c) Provide accurate and complete information during registration. • d) Comply with these Terms and all applicable laws. Users under 18: may register and take courses only under the responsibility of their legal guardian, who accepts these Terms on their behalf and assumes the resulting obligations. Certain certified courses impose additional regulatory requirements regarding age, medical certification, and guardian authorization. For example, under RAV 60 and RAV 67, the Student Pilot license requires a minimum age of seventeen (17), notarized guardian authorization if the applicant is a minor, and a valid aviation medical certificate. Verification of these requirements is the responsibility of the ATO enrolling the Student, within its obligations before INAC. ALAS does not replace or assume that verification. 6. User accounts • a) You must provide accurate and complete information when creating your account and keep it updated. • b) You are responsible for the confidentiality of your credentials and for all activity under your account. • c) You must not share your account or allow unauthorized access. • d) You must create only one account per person, unless expressly authorized by ALAS. • e) You must notify us immediately at info@skyalas.com if you suspect unauthorized use of your account. • f) ALAS reserves the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity. 7. Courses and content 7.1 Not a license or rating Completion certificates issued through ALAS LMS evidence the successful completion of a training program. They do not constitute licenses, type ratings, instrument ratings, or any other regulatory approval or endorsement, unless expressly stated by the issuing ATO and confirmed by the competent aviation authority (such as INAC). It is your responsibility to verify whether a specific course or certificate satisfies the regulatory, professional, or employment requirements applicable to your situation. 7.2 Relationship with the ATO Your participation in courses offered by an ATO through ALAS LMS does not establish any employment, contractual, or institution-student relationship between you and the ATO beyond the specific course in which you enroll. ALAS acts as a technology provider and does not assume the ATO's academic or regulatory responsibilities. 7.3 Course modifications ALAS and the ATOs reserve the right to modify, update, cancel, or reschedule courses, including changes to content, structure, evaluation criteria, and scheduling. We will make reasonable efforts to notify enrolled students of material changes. 8. Payment terms (ALAS proprietary courses) The following terms apply exclusively to ALAS proprietary courses. Certified courses are governed by the payment terms set by the relevant ATO. 8.1 Pricing Prices for proprietary courses are displayed on the platform in US dollars (USD) unless otherwise indicated. ALAS reserves the right to modify prices at any time; changes will not affect enrollments already purchased. 8.2 Payment methods We currently accept the following methods, in the order offered: • a) Bank transfer (national payments in Venezuelan Bolívares). • b) Pago Móvil (national payments in Venezuelan Bolívares). • c) Zelle (international payments in USD). • d) Binance / cryptocurrency. Additional payment methods may be added in the future. 8.3 Manual payment verification For methods requiring manual verification, the enrollment process is: (a) you select the course and payment method; (b) the platform displays instructions and account details; (c) you complete payment outside the platform; (d) you upload proof of payment to the platform or send it via WhatsApp to +58 424-471-0728; (e) ALAS verifies the payment and approves enrollment; (f) you receive email confirmation and course access. ALAS will make reasonable efforts to verify payments within 24 hours of receiving proof of payment, excluding weekends and holidays. 8.4 Currency and exchange rate For payments in Venezuelan Bolívares, the applicable exchange rate will be determined at the time of payment based on the rate published by the Central Bank of Venezuela (BCV) or as otherwise specified by ALAS. 9. Refund policy (ALAS proprietary courses) This policy applies exclusively to ALAS proprietary courses. For certified courses, the refund policy is determined by the ATO; ALAS does not manage and is not responsible for refunds of payments made to an ATO. • a) Refund requests must be submitted within 7 calendar days of enrollment and before completing more than 25% of the course content. • b) No refunds will be issued after a completion certificate has been generated. • c) Approved refunds will be processed using the original payment method within 10 business days. • d) Requests should be directed to info@skyalas.com. • e) ALAS reserves the right to deny refunds in cases of violation of these Terms or fraudulent activity. 10. Certificates • a) Completion certificates are issued upon successful fulfillment of all course requirements, as defined by the program and the issuing institution. • b) Certificates for courses offered by an ATO are issued under the ATO's authority and include its branding and signature. The text "managed through ALAS LMS (skyalas.com)" indicates that the course was delivered, tracked, or administered through our platform. • c) Certificates for proprietary courses are issued under the authority of ALAS. • d) All certificates include a unique QR code and certificate ID for online verification. • e) Students retain permanent access to their certificates through their account, even after course access is closed. • f) Any attempt to falsify, alter, or fraudulently represent a certificate is strictly prohibited and may result in account termination and legal action. 11. User conduct and honor code By using ALAS LMS, you agree to the following standards of conduct: • a) You will not share, distribute, sell, or commercially exploit course materials without prior written consent. • b) You will not attempt to access other users' accounts, data, or certificates. • c) You will not use automated systems, bots, or scripts to interact with the platform. • d) You will not submit false information in registration, evaluations, or payment documentation. • e) You will not engage in plagiarism, use unauthorized materials during evaluations, or any form of academic dishonesty. • f) You will not engage in conduct that disrupts the platform, compromises its security, or harasses other users. • g) You will not use the platform for any purpose other than legitimate educational activities. Violations may result in suspension or termination of your account, revocation of certificates, and forfeiture of fees paid. Serious violations may be reported to the relevant aviation authorities. 12. Intellectual property All course content, materials, videos, logos, designs, software, and platform infrastructure are the intellectual property of ALAS or its authorized content providers (including ATOs). Users may not reproduce, distribute, modify, reverse engineer, or commercially exploit any platform content without prior written consent. You retain ownership of any original content you submit through the platform (such as forum posts or assignment submissions). By submitting it, you grant ALAS a non-exclusive, worldwide, royalty-free license to use, store, and display that content for the purpose of operating the platform and providing our services. 13. Service availability ALAS LMS is provided "as is" and "as available". We make reasonable efforts to maintain platform availability and performance, but we do not guarantee uninterrupted, error-free, or secure operation at all times. We may suspend access for maintenance, updates, or security reasons, making reasonable efforts to provide advance notice when possible. We are not liable for disruptions or losses resulting from connectivity issues, server outages, power failures, or other events beyond our reasonable control. 14. Limitation of liability To the maximum extent permitted by Venezuelan law: • a) ALAS shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform. • b) ALAS's total aggregate liability for any claim related to these Terms or the platform shall not exceed the total amount of fees you paid to ALAS in the 12 months preceding the claim. • c) ALAS is not responsible for the academic content, quality of instruction, or regulatory validity of courses offered by ATOs through the platform. • d) ALAS does not guarantee any specific employment, licensing, or career outcome from completing courses on the platform. 15. Indemnification You agree to indemnify and hold harmless ALAS, its officers, employees, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use or misuse of the platform; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content you submit through the platform. 16. Governing law and jurisdiction These Terms are governed by and construed in accordance with the laws of the Bolivarian Republic of Venezuela. Any dispute arising from or related to these Terms or the use of the platform shall be submitted to the competent courts of Maracay, Aragua State, Venezuela. If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect. 17. Modifications to these Terms ALAS reserves the right to modify these Terms at any time. Changes will be posted on the platform with an updated revision date.
